1 Agreement to Terms

By accessing or using CubbyDocs at cubbydocs.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all visitors, users, and anyone who accesses or uses the Service.

These Terms form a legally binding agreement between you and CubbyDocs, operated as a sole proprietorship ("CubbyDocs," "we," "us," or "our").

2 What CubbyDocs Does

CubbyDocs is a document generation service. You provide information through a form, and our service uses that information to generate a professionally formatted document template, which is delivered to your email address.

We make no representation that any document generated by CubbyDocs will satisfy the specific requirements of any particular state licensing authority, regulatory body, or legal proceeding.

3 Eligibility

You must be at least 18 years old to use CubbyDocs. By using the Service, you confirm that you are 18 or older and have the legal capacity to enter into a binding agreement. CubbyDocs is intended for use by licensed or unlicensed home daycare providers and childcare professionals operating in a professional capacity.

4 Free Trial, Free Tier & Paid Subscriptions

Free trial: New users may claim a 14-day free trial via Gumroad at no cost. The free trial provides full access to all document types for the duration of the trial period. A Gumroad account is required to claim the free trial. We reserve the right to modify or discontinue the free trial at any time with reasonable notice.

Free tier: After the free trial period ends, users are automatically moved to a permanent free tier providing one document generation per month at no cost, with no payment required. We reserve the right to modify or discontinue the free tier at any time with reasonable notice.

Paid subscriptions: Paid plans are available on a monthly or annual basis. By subscribing, you authorize us (via our payment processor, Gumroad) to charge your payment method on a recurring basis — monthly or annually depending on the plan you select — until you cancel.

Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — you will not be charged again after cancellation, and you retain access to paid features until the period ends.

5 Acceptable Use

You agree to use CubbyDocs only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service to generate fraudulent, falsified, or deliberately misleading documents
• Submit false or fabricated information about children, incidents, or facilities in document forms
• Attempt to circumvent any usage limits, payment requirements, or access controls
• Share, resell, or redistribute paid access credentials or license keys
• Use automated scripts, bots, or tools to submit forms or generate documents in bulk without our written permission
• Reverse engineer, copy, or replicate the Service or its document templates for commercial use
• Use the Service in any way that could harm, disable, or impair it or interfere with other users

Fair use: "Unlimited" document generation on paid plans is subject to fair use and is intended for individual childcare providers operating a single home daycare facility. Use that is inconsistent with normal personal business operations — including generation of documents across multiple unaffiliated facilities, automated or scripted submissions, or any use that places unusual demand on the Service — may result in suspension at our discretion.

We reserve the right to suspend or terminate access for any user found in violation of these terms, without notice and without refund.

6 Your Content & Responsibility

When you submit information through our forms to generate a document, you represent that:

• The information you provide is accurate and truthful to the best of your knowledge
• You have the right to submit any information about the children or families in your care for the purpose of generating professional documentation
• You will handle any generated documents containing personal information about children in accordance with applicable privacy laws and your state's childcare regulations

Form submission data is transmitted to our automation pipeline to generate your document. Submissions may be retained temporarily in our form provider's dashboard (Tally.so) and are deleted on a regular basis, no longer than 30 days after submission. This data is never used for any purpose beyond generating your requested document. You are responsible for storing, securing, and retaining the documents you generate in accordance with your legal and professional obligations.

7 Intellectual Property

The CubbyDocs name, logo, website design, and document template structures are the intellectual property of CubbyDocs and may not be copied, reproduced, or used commercially without written permission.

The completed documents generated for you based on your form inputs are yours to use for their intended professional purpose. You may print, file, and distribute them in the normal course of your childcare business. You may not resell or redistribute CubbyDocs-generated documents as your own templates or products.

8 Disclaimer of Warranties

Your use of the Service is at your sole risk. You should always review generated documents carefully and consult with a qualified professional or your state licensing agency if you have questions about specific compliance requirements.

9 Limitation of Liability

To the fullest extent permitted by applicable law, CubbyDocs and its owner shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to:

• Reliance on a generated document that does not meet a specific state's requirements
• Loss of data, documents, or records
• Any regulatory, licensing, or legal consequence arising from the use of a generated document
• Service interruptions or inability to access the Service

Our total liability to you for any claim arising from use of the Service shall not exceed the amount you paid to CubbyDocs in the three months preceding the claim, or $50, whichever is greater.

10 Indemnification

You agree to indemnify and hold CubbyDocs harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your submission of false or misleading information through our forms.

11 Third-Party Services

CubbyDocs uses third-party services to operate, including Anthropic (AI generation), Make.com (automation), Tally.so (forms), Cloudflare (hosting), and Gumroad (payments). Your use of these third-party services is subject to their own terms and privacy policies. CubbyDocs is not responsible for the practices or content of any third-party service.

12 Service Availability & Changes

We reserve the right to modify, suspend, or discontinue the Service at any time, with or without notice. We may also update these Terms at any time. When we do, we will update the "Last updated" date above. Continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.

If we make material changes that affect your paid subscription, we will notify you by email at least 14 days in advance.

13 Governing Law

These Terms are governed by the laws of the United States. Any disputes arising from these Terms or your use of the Service shall be resolved through good-faith negotiation first. If a dispute cannot be resolved informally, it shall be submitted to binding arbitration in accordance with the American Arbitration Association's rules, rather than resolved in court, except where prohibited by law.

14 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CubbyDocs regarding your use of the Service. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
